1. Acceptance of Terms

By registering for, accessing, or using Kirim.Chat, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you are entering into these terms on behalf of a company or other legal entity, you represent that you have the legal authority to bind such entity. If you do not agree with any part of these terms, you must not use our services.

2. Description and Scope of Services

Kirim.Chat is a cloud-based business communication platform provider that offers access to:

• Third-party Application Programming Interfaces (APIs) (including but not limited to WhatsApp Business API and Meta Platforms).
• Centralized messaging management systems (Omnichannel) and CRM integrations.
• Data analytics services, message performance reporting, and delivery logs.
• Message automation features, template management, and interactive bots.

3. Third-Party Compliance (WhatsApp/Meta)

As a user of services integrated with Meta Platforms, Inc., you are strictly required to comply with all current WhatsApp Business policies, including the Commerce Policy and WhatsApp Business Policy. Kirim.Chat is not liable for any suspension, blocking, or termination of your account by third parties (Meta/WhatsApp) resulting from policy violations.

4. Accounts and Security

In managing your account, you are obligated to:

• Provide accurate, complete, and up-to-date identification data in accordance with valid legal documents.
• Maintain the confidentiality of your password and API Keys from any unauthorized access.
• Notify us in writing within a maximum of 24 hours if any unauthorized access to your account is detected.
• Accept full responsibility for all activities, communications, and transactions conducted through your account.

5. Acceptable Use Policy

You are strictly prohibited from using Kirim.Chat services for:

• Activities that violate the laws of the Republic of Indonesia or laws in the jurisdiction where you operate.
• Sending bulk messages (spam), promotional messages without explicit recipient consent (Opt-in), or messages that disturb the comfort of end-users.
• Distributing harmful content, viruses, malware, pornographic material, gambling, or content containing hate speech or harassment.
• Attempting to decompile, reverse engineer, or undermine the integrity of our server infrastructure.
• Using automated scripts to extract data or manipulate the system without written permission.

10. Termination

We reserve the right to unilaterally suspend or terminate access to the service without notice if a material breach of these Terms of Service is detected. You may terminate your subscription at any time via the control panel; however, any outstanding payment obligations must be settled.

8. Indemnification

You agree to indemnify, defend, and hold harmless Kirim.Chat, its directors, employees, and partners from any legal claims, losses, costs (including attorney fees), or liabilities arising from your misuse of the service or your violation of these Terms of Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Kirim.Chat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption arising from your use of the service or third-party technical failures.
